1.2 Scope

These Terms of Service apply to the use of the mobile application "AI Wiki" (hereinafter "App") and all related services.

2. Service Description

2.1 App Features

  • AI-generated nutrition information: Automatically created wiki articles on nutrition topics
  • User moderation: Ability to rate and improve content
  • Bookmark function: Saving articles
  • Premium subscriptions: Extended features for a fee
  • Affiliate links: Redirection to external merchants

2.2 AI-Generated Content

  • Content is created by artificial intelligence (Google Gemini)
  • Important Notice: AI-generated content serves only for general information
  • It does NOT replace professional medical, nutritional therapy, or medical advice
  • For health problems, always consult qualified professionals

3. Registration and User Account

3.1 Registration

  • Usage is possible with anonymous account or Google sign-in
  • Truthful information must be provided during registration
  • Only one account per person is allowed

3.2 Account Security

  • You are responsible for your account security
  • Suspicious activities must be reported immediately
  • Abuse may result in account suspension

4. User Behavior and Prohibited Activities

4.1 Permitted Use

  • Personal, non-commercial use
  • Rating and constructive feedback on content
  • Sharing content on social media

4.2 Prohibited Activities

  • AI function abuse: Spam, irrelevant requests, manipulation
  • Harmful content: Spreading misinformation, medically dangerous advice
  • Technical manipulation: Reverse engineering, hacking, bot usage
  • Copyright violations: Copying and commercial exploitation of content
  • Feedback system abuse: Fake ratings, coordinated manipulation

5. Intellectual Property and License

5.1 Copyright

  • The app and its content are protected by copyright
  • AI-generated content is subject to our copyright
  • User contributions (feedback, ratings) grant us a free, worldwide usage right

5.2 Usage License

We grant you a limited, non-exclusive, non-transferable license for personal use of the app.

6. Premium Subscriptions and Payments

6.1 Subscription Options

  • Monthly: €6.99/month
  • Annually: €49.99/year
  • Lifetime: €149.99 (one-time)

6.2 Payment Processing

  • Payments are processed via App Store/Google Play Store
  • The Terms of Service of the respective store provider apply
  • Prices include statutory VAT

6.3 Right of Withdrawal (EU)

  • 14-day right of withdrawal when concluding subscription
  • Withdrawal must be declared in writing or by email
  • Right of withdrawal expires for already used digital content

6.4 Cancellation

  • Subscriptions can be cancelled anytime in store settings
  • Upon cancellation, subscription runs until end of paid period
  • No automatic refund for early cancellation

7. Affiliate Links and Commissions

7.1 Disclosure

  • Links to external merchants are marked as affiliate links
  • We receive commission on purchases
  • This does not affect the purchase price for you

7.2 External Providers

  • We are not responsible for products or services of external providers
  • The Terms of Service of the respective merchants apply
  • Complaints should be directed to the merchant

8. Disclaimer and Limitation of Liability

8.1 Medical Disclaimer

  • IMPORTANT: App content is not medical advice
  • For health problems, consult doctors or nutritionists
  • We assume no liability for health damage from app use

8.2 AI Content

  • AI-generated content may contain errors
  • We provide no warranty for completeness or accuracy
  • User feedback may contribute to improvement but does not guarantee correctness

8.3 General Limitation of Liability

  • Liability only for intent and gross negligence
  • Excluded: Damage to life, body, health
  • Liability limited to typical, foreseeable damages

9. Availability and Technical Issues

9.1 Availability

  • We strive for high availability but cannot guarantee it
  • Maintenance work may lead to temporary outages
  • For longer outages, we inform via available channels

9.2 Rate Limits

  • Anonymous users: 5 requests/hour
  • Registered users: 10 requests/hour
  • Premium users: 50 requests/hour
  • Access is temporarily limited when exceeded

10. Privacy

The collection and processing of personal data is governed by our separate privacy policy, which is an integral part of these Terms of Service.

11. Termination and Account Suspension

11.1 Ordinary Termination

  • You can delete your account at any time
  • We can discontinue the service with 30 days' notice

11.2 Extraordinary Termination

For serious violations, we can immediately suspend accounts:

  • Violation of these Terms of Service
  • Abuse of AI functions
  • Technical manipulation
  • Legal violations

12. Changes to Terms of Service

  • Changes are announced 30 days in advance
  • In case of objection, you can use the service until it takes effect
  • Continued use is considered consent to changes

13. Dispute Resolution and Applicable Law

13.1 Applicable Law

German law applies, excluding UN sales law.

13.2 Jurisdiction

  • For consumers: Your residence or our business location

13.3 Online Dispute Resolution

The EU Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr/.

14. Severability Clause

If individual provisions are invalid, this does not affect the validity of the remaining provisions.
